1. Acceptance of Terms
Welcome to Plotline, a mobile application operated by Plotline Travel, Inc. ("Company," "we," "us," or "our"). By downloading, accessing, or using the Plotline application (the "App") or our related services, you agree to be bound by these Terms and Conditions (the "Terms").
If you do not agree to these Terms, you must not access or use the App.
2. Description of Services
The App provides travel discovery and itinerary planning tools. You can save places ("plot points") from social media, websites, and maps; organize them into collections; and generate AI-powered day-by-day itineraries ("plans").
3. Eligibility
You must be at least 16 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.
4. User Accounts
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
5. Artificial Intelligence Disclaimer
The App utilizes third-party AI technologies, specifically Google Gemini and Anthropic Claude, to extract place information from shared content and generate itineraries.
Accuracy: AI technologies may produce inaccurate, outdated, or incomplete information. We do not guarantee the accuracy of place names, opening hours, pricing, travel requirements, or other information generated by the AI.
No Professional Advice: The App is for informational purposes only. It is not a substitute for professional travel agency services, legal advice (e.g., visa requirements), or emergency services.
User Responsibility: You are solely responsible for verifying all information with official sources before traveling.
6. Travel Risks and Physical Safety
The App may recommend locations or activities based on social media content or AI analysis.
Assumption of Risk: You acknowledge that travel involves inherent risks, including bodily injury, illness, and property damage. You assume all risks associated with visiting locations recommended by the App.
Safety: We do not vet the safety or quality of specific locations, venues, or third-party service providers mentioned in the App.
7. Third-Party Services
The App relies on third-party services for content extraction, AI processing, data storage, analytics, and other functionality. A complete list of third-party service providers and the data shared with each is available in our Privacy Policy.
No Control: We do not control and are not responsible for the content, privacy policies, or practices of any third-party services.
8. User Content
Your Content: You retain ownership of the notes, descriptions, and other data you create in the App ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for the purpose of operating and improving the App.
Social Media: If you choose to import content via links from third-party platforms (e.g., Instagram, TikTok, YouTube), you represent that you have the right to access that content. We extract publicly available information (captions, place names, metadata) from those links to generate recommendations.
Shared Collections: If you share a collection with another user, they will be able to view the places, descriptions, and notes included in that collection.
9. Subscriptions and Payments
The App may offer premium features through subscription plans.
In-App Purchases: Subscriptions are processed via Apple's App Store. Your payment method will be charged by Apple upon confirmation of purchase.
Auto-Renewal: Subscriptions automatically renew unless you turn off auto-renewal at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time through your device's Settings > Apple ID > Subscriptions.
Refunds: We do not handle payments or refunds directly. All refund requests must be directed to Apple Support.
10. Account Deletion
You may delete your account at any time from within the App (Profile > Delete Account). Account deletion permanently removes your personal data, saved places, collections, and plans. If you have an active subscription, you must cancel it through Apple's subscription management (Settings > Apple ID > Subscriptions) before or after deleting your account, as Apple will continue to charge you unless you cancel directly with Apple.
11. Prohibited Conduct
You agree not to:
- Use the App for any illegal purpose.
- Harass, abuse, or harm another person or group.
- Reverse engineer, decompile, or attempt to extract the source code of the App.
- Use automated scripts to collect information from or otherwise interact with the App.
12. Intellectual Property
The App, including its design, source code, text, and graphics (excluding User Content), is the property of Plotline Travel, Inc. and is protected by copyright, trademark, and other intellectual property laws.
13. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE APP WILL MEET YOUR REQUIREMENTS OR BE ERROR-FREE.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PLOTLINE TRAVEL, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; (C) ANY CONTENT OBTAINED FROM THE APP; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX MONTHS.
15. Indemnification
You agree to defend, indemnify, and hold harmless Plotline Travel, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.
16. Apple App Store Terms
If you downloaded the App from Apple's App Store, the following additional terms apply:
- These Terms are between you and Plotline Travel, Inc. only, and not with Apple. Plotline Travel, Inc., not Apple, is solely responsible for the App and its content.
- Apple has no obligation to provide maintenance or support services for the App.
- Apple has no warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- In the event of any third-party claim that the App infringes that third party's intellectual property rights, Plotline Travel, Inc., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
17. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of laws provisions. Any disputes arising out of these Terms or the use of the App shall be resolved in the state or federal courts located in Delaware.
18. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page or through the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
