01Overview
Plotline Travel, Inc. ("Plotline," "we," "us") respects the intellectual property rights of others and expects the people who use Plotline to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act, 17 U.S.C. § 512 (the "DMCA").
Plotline saves places from posts that people share with it. When a place comes from a post, Plotline may show a link back to that post along with its title, a thumbnail, the creator's handle and a short summary of what the post says about the place. This page explains how a copyright owner can ask us to remove material from Plotline, how the person who saved it can respond, and what happens to anyone who misuses the process.
This page covers copyright only. For trademark, privacy or impersonation concerns, or for incorrect place information, email info@getplotline.app instead.
02Before you file
A takedown notice is a legal document, and you sign it under penalty of perjury. Submit one only if every statement below is true:
- You own the copyright in the work, or you are authorized to act on behalf of the person or company that owns it.
- The material appears on Plotline, in the app or on a getplotline.app page. Removing it from Plotline does not remove it from TikTok, Instagram, YouTube or anywhere else. Contact those services directly.
- You have not licensed or otherwise permitted the use.
- You have considered whether the use is a fair use or is otherwise permitted by law. Copyright owners must consider fair use before sending a takedown notice (Lenz v. Universal Music Corp., 801 F.3d 1126 (9th Cir. 2015)).
- You can identify both your original work and the specific material on Plotline.
Facts are not protected by copyright, so a place's name, address, opening hours or category, or the fact that your post recommended it, cannot be removed through this process. If you are unsure whether material infringes your copyright, talk to a lawyer before you file.
03Submit a notice
Complete every field marked with an asterisk. The form collects everything the DMCA requires of a notice (17 U.S.C. § 512(c)(3)), and it goes straight to our designated agent. We may not be able to act on a notice that is incomplete or inaccurate. Submitting the same notice more than once will not speed up its review.
Notice received
Your reference is . Our designated agent will review the notice and reply to . Keep the reference for your records.
04What happens next
- We review every notice. If yours is missing information, we may ask you for it or decline to act on the notice.
- If the notice is valid, we will remove or disable access to the material expeditiously.
- We will tell the user who saved or shared the material that it was removed, and we may send them a copy of your notice. We may redact your email address, phone number and mailing address from that copy.
- The user may send a counter-notice (section 05). If they do, we will send you a copy. We may restore the material no less than 10 and no more than 14 business days after we receive the counter-notice, unless our designated agent first receives notice from you that you have filed a court action seeking to restrain the user from the claimed infringing activity on Plotline.
05Counter-notices
If material you saved or shared was removed because of a notice, and you believe it was removed by mistake or misidentification, you may send a counter-notice to our designated agent (section 08) by email or mail. Under 17 U.S.C. § 512(g)(3), it must include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled, and where it appeared on Plotline before it was removed.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Plotline may be found), and that you will accept service of process from the person who filed the original notice or that person's agent.
We will send a copy of your counter-notice, including your contact details, to the person who filed the original notice. Counter-notices carry the same liability for misrepresentation as notices (section 07).
06Repeat infringers
Plotline will, in appropriate circumstances, disable or terminate the accounts of users who repeatedly infringe the copyrights of others. We may also remove material, or limit or end access to Plotline, for anyone who infringes intellectual property rights, at our discretion and with or without notice.
07False claims
Do not misuse this process. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, is liable for any damages, including costs and attorneys' fees, incurred by the alleged infringer, by any copyright owner or authorized licensee, or by Plotline, as a result of our relying on that misrepresentation.
The statements in a notice and in a counter-notice are made under penalty of perjury. Plotline reserves the right to seek damages from anyone who submits a false notice or counter-notice, and to decline notices that are abusive or sent in bad faith, such as notices meant to remove lawful content or to harass a user.
Nothing on this page is legal advice. If you are unsure of your rights, consult a lawyer.
